About These Terms
These Website Terms and Conditions (“Terms”) govern your use of https://www.publicsquaredigital.com (the “Website”), operated by Public Square Digital LLC, doing business as Public Square Digital (“Public Square Digital,” “we,” “us,” or “our”). The Website provides information about our products and services and allows you to contact us, request a demonstration, or begin the sign-up process.
By using the Website after receiving notice of these Terms, you agree to them to the extent permitted by applicable law. If you do not agree, please stop using the Website. If you act on behalf of an organization, you represent that you have authority to do so.
These Terms apply only to the public-facing Website. Access to PSD Network, PSD Walk, PSD Polling, and other platform services—including subscriptions, customer data, and permitted use of voter information—is governed by the applicable customer agreement, order form, and any additional product terms. These Website Terms do not grant access to those services or replace those agreements. If there is a conflict concerning purchased services, the applicable customer agreement controls.
Using the Website
You may use the Website for lawful purposes, including learning about Public Square Digital, evaluating our services, and contacting our team. When submitting a request, you must provide accurate information and have authority to provide any information about another person or organization.
You agree not to:
- Violate applicable law or infringe another person’s intellectual property, privacy, or other rights.
- Impersonate another person or misrepresent your identity, affiliation, or authority.
- Submit malware, fraudulent requests, spam, or content intended to disrupt the Website or harm others.
- Attempt to access nonpublic systems, accounts, or data without authorization, or bypass access restrictions or security controls.
- Use automated tools to extract personal information or impose an unreasonable load on the Website.
- Copy, resell, or exploit Website content except as permitted by these Terms, our written permission, or applicable law.
These restrictions do not limit rights that applicable law does not allow us to restrict. Automated access is permitted only when expressly authorized and only within the scope of that authorization.
Ownership and Permitted Use
The Website and its text, graphics, designs, logos, software, and other content are owned by Public Square Digital or its licensors and are protected by applicable intellectual property laws.
You may view the Website and download or print reasonable portions for your personal use or your organization’s internal evaluation of our services, as long as copyright and other ownership notices remain intact. This permission does not transfer ownership or authorize commercial redistribution, modification, or use of our trademarks in a way that suggests sponsorship or endorsement.
Third-party names and trademarks belong to their respective owners. Nothing in these Terms limits lawful quotation, fair use, or other rights provided by law.
Information You Submit
When you submit an inquiry or demonstration request, you authorize us to use its contents to respond, provide the information you request, and administer that interaction, subject to our Privacy Policy. You retain ownership of materials you submit and grant us only the permission reasonably needed to handle your request.
Please do not submit confidential campaign records, voter lists, payment card information, passwords, or materials you are not authorized to share through general Website forms. If your request requires sensitive information, contact us to arrange an appropriate method for providing it.
Submitting a form does not create a subscription, guarantee a demonstration time, or establish a confidential advisory relationship. We will confirm any arrangements with you separately.
Product Descriptions and Pricing
Website descriptions, illustrations, demonstrations, and pricing are provided to help you evaluate our services. Features may vary by plan, location, availability, and the terms of your agreement. Illustrations may contain sample data and may differ from the live product. Roadmap descriptions reflect current plans and do not guarantee that a feature will be released by a particular date.
Any purchase is subject to the pricing, billing period, commitment, renewal terms, cancellation process, refund policy, taxes, and other terms disclosed in the applicable order form or checkout flow and customer agreement. These Website Terms do not independently impose subscription fees or automatic renewal obligations.
We may correct Website errors and update information. A Website update does not change an existing customer agreement or eliminate rights available under applicable law.
No Professional Advice or Guaranteed Outcome
Website content is general product and business information. It is not legal advice, campaign finance advice, election administration guidance, or a substitute for advice from a qualified professional.
References to voter data, organizing, canvassing, polling, or artificial intelligence do not guarantee an election result, polling accuracy, turnout, fundraising outcome, or legal compliance. You are responsible for evaluating whether services meet your needs and for obtaining advice about your own activities. Nothing in this section changes an express commitment in a customer agreement or excuses conduct that cannot lawfully be excused.
Privacy and Communications
Our Privacy Policy explains how we handle information collected through the Website and related business communications.
We may respond to your inquiry using the contact information you provide, consistent with applicable law and your communication preferences. Acceptance of these Terms is not consent to automated marketing calls or texts. Any applicable messaging consent and program terms will be presented separately. You may opt out of marketing communications as described in the Privacy Policy.
Links and Outside Services
The Website may include links or connections to third-party websites and services, including scheduling, authentication, and payment services. Those services may have their own terms and privacy notices. A link does not by itself mean we endorse the third party or control its content.
We are not responsible for third-party content or services outside our control, except to the extent applicable law or our agreement with you provides otherwise.
Website Availability and Warranties
We may update, suspend, or discontinue all or part of the Website. We do not promise uninterrupted or error-free Website access. This section does not change service availability commitments in a separate customer agreement.
To the fullest extent permitted by law, the Website and its content are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not guarantee that Website content is complete, current, or free of errors. This disclaimer does not override express contractual commitments, prohibit reliance on representations where the law protects that reliance, or exclude warranties that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, Public Square Digital will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the public-facing Website. This includes lost profits, lost opportunities, and lost data, even if we have been advised of the possibility of those damages.
This exclusion does not apply to fraud, willful misconduct, gross negligence, or liability that cannot be excluded under applicable law. It does not limit rights or remedies that the law does not allow you to waive. Liability relating to purchased services is governed by the applicable customer agreement.
Restricting Access
We may restrict Website access when reasonably necessary to address misuse, a security risk, a violation of these Terms, or a legal requirement. You may stop using the Website at any time. Provisions that by their nature should continue—including ownership, applicable disclaimers, and dispute provisions—survive the end of Website use.
Governing Law and Disputes
These Terms are governed by the laws of the State of North Carolina, without applying conflict-of-law rules that would require another jurisdiction’s laws, except where mandatory law requires otherwise.
Subject to any rights you have under mandatory law, disputes arising from these Terms or Website use will be brought in the state courts located in Carteret County, North Carolina, or, where federal subject-matter jurisdiction exists, the United States District Court for the Eastern District of North Carolina. The parties consent to the personal jurisdiction of those courts. This provision does not take away any nonwaivable right to bring a claim in another court.
You may contact contact@publicsquaredigital.com to raise a concern. Contacting us first is not a condition of exercising a legal right and does not shorten or extend a filing deadline.
Changes to These Terms
We may revise these Terms by posting an updated version and effective date. Material changes will be brought to your attention through a Website notice or another appropriate method, and we will obtain agreement where required by law. Changes apply prospectively and do not retroactively alter an existing dispute or a separate customer agreement.
General Provisions
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver of our right to enforce it later. These Terms constitute the agreement concerning use of the public-facing Website, subject to any additional agreement that expressly applies to the relevant interaction.
